O'Hara Vacances has just forged a partnership with PRESENCE ASSISTANCE TOURISME to provide you with cancellation insurance and vacation interruption protection. We strongly advise you to sign up for this insurance in case you need to cancel your reservation for any of the reasons listed bellow. You will be reimbursed for the cancellation fees (not including taxes, booking fees, and insurance premium).

DEADLINE FOR SIGNING UP FOR INSURANCE In order for the cancellation insurance to be valid, the current contract must be signed at the same time as the trip reservation or before the date that cancellation fees become applicable.
GENERAL CONDITIONS Like all insurance contracts, there are rights and responsibilities required from both sides. The contract is regulated by the insurance code. These rights and responsibilities are listed in the following pages.
CONDITIONS COMMON TO THE LIST OF GUARANTEES DEFINITIONS THE INSURED Duly insured persons in the contract hereunder, designated by the term "you" under the conditions that they live in Europe (country belonging to the European Community, Switzerland, Norway, and the Principality of Monaco).
INSURER ASSUREUR / ASSISTEUR GAN Eurocourtage hereafter referred to by the term "us." SICKNESS / ACCIDENT A change in health declared by a medical authority necessitating medical attention and the complete termination of all professional or other activities.
EUROPE The term "EUROPE" includes all countries in the European Community, Switzerland, Norway, and the Principality of Monaco. EXEMPTION Portion of the indemnity that you keep. DOMICILE Domicile refers to your permanent place of residence. Your domicile must be located in Europe (countries in the European Community, Switzerland, Norway, and the Principality of Monaco). FAMILY MEMBERS A family member refers to a legal spouse, child, brother, or sister, mother, father, step-parents, grandparents, grandchildren, in-laws (mother-, father-, brother-, or sister-in-laws), and in case of death, an uncle, aunt, nephew, or niece.
BODILY HARM Any physical bodily harm suffered by a person, and any injury resulting therewith.
MATERIAL DAMAGE Any harm, destruction, alteration, loss or disappearance of an object or substance as well as any physical harm to an animal.
CONSECUTIVE IMMATERIAL DAMAGE Any monetary harm resulting from the depriving of the enjoyment of your rights, the interruption of a service rendered by a person or by personal property or building, or from the loss of a profit, andwhich is the direct consequence of insured bodily harm or material damage.
WHAT IS THE GEOGRAPHICAL COVERAGE OF THE CONTRACT? The warranty and/or the services agreed to on the current contract is applicable anywhere in the world.
WHAT IS THE DURATION OF THE CONTRACT? The period of validity corresponds to the period of the services sold by the trip organiser. Under no conditions is the warranty to exceed 3 months from the departure date of the trip. The "CANCELLATION" warranty takes effect at the sign date of the current contract and expires on the departure date of the trip.
WHAT ARE THE GENERAL EXCLUSIONS APPLICABLE TO OUR WARRANTY? We cannot intervene when your insurance requests or services are the consequence of damages resulting from: . epidemics, natural disasters and pollution; . Civil or foreign war, riots, or popular uprising; . The voluntary participation of an insured person in a riot or a strike; . An atomic explosion or any radiation originating from ionising rays; . Alcoholism, drunkenness, use of medication, drugs, and narcotics not medically prescribed; . any intentional action that can put the guarantees of the contract into effect; . duels, bets, crimes, brawls (except in the case of legitimate defense); . The participation in the following sports: bobsleigh, skeleton, mountaineering, competitive luge, aerial sports with the exception of paragliding, and sports requiring an extra fee, or practices for officially sponsored games or competitions organised by a sports federation. . the absence of any hazard. HOW IS YOUR INDEMNITY CALCULATED? If the indemnity cannot be determined upon through mutual agreement, it will be evaluated by means of friendly expertise, under the conditions of our respective claims. Each party will choose an expert. If the experts cannot reach an agreement, a third party will be called in and the three will work together with majority ruling. If one party fails to select an expert, or if the two chosen experts fail to agree on the choice of a third expert, the selection will be made by the President of the Tribunal de Grande Instance, presiding in summary procedure. Each of the contract co-signers will take responsibility of the fees for their expert, and if necessary, half the fees of the third expert.
HOW LONG WILL IT TAKE TO YOU TO BE COMPENSATED? Payment should be received within 15 days from the date of agreed between the two parties or from the date of notification of the executive judiciary decision. WHAT ARE THE METHODS OF EXAMINING COMPLAINTS? SUBROGATION After compensation has been paid, with the exception of that paid as vacation accident insurance, we are subrogated in the rights and actions that you might have against third parties responsible for the damage, as stated in article L.121-12 of the insurance code. Our subrogation is limited to the total of the indemnity paid to you or the services we have provided.
WHEN DOES THE STATUTE OF LIMITATIONS EXPIRE? Any action regarding this contract must be carried within two years of the date of the incident that caused said actions in the conditions determined by articles L.114-1 et L.114-2 of the insurance code.
WHAT ARE THE LIMITS APPLICABLE IN CASE OF A FORCE MAJEURE? We cannot be held accountable for failure to carry out assistance services resulting from a force majeure or any of the following events: civil or foreign war, common-knowledge political instability, popular uprisings, riots, terrorist acts, reprisals, restriction of free circulation of people and goods, strikes, explosions, natural disasters, atomic explosions, or delays in the carrying out of services resulting from these causes.
CANCELLATION FEES WHAT DO WE GUARANTEE? If you find it necessary to cancel your trip before departure, we will reimburse your deposit and all balances held by the organiser of the trip, after exemption deductions indicated in the table of warranty provisions and billed according to the general sales conditions (excluding the booking free and insurance premium).
IN WHICH SITUATIONS WILL WE INTERVENE? We will intervene exclusively for the reasons and circumstances listed below.
SEVERE ILLNESS, MAJOR ACCIDENT OR DEATH (Including relapse, aggravation of a chronic or pre-existing illness, as well as after effects or repercussions of an accident that arises prior to signing the contract) Affecting: - you and your spouse; - your parents, grandparents, children or grandchildren and/or those of your spouse; - your brothers, sisters, brothers-, sisters-, sons-, and daughters-in law; in case of death your uncle, aunt, nephews and nieces - your professional replacement, provided that his/her name is mentioned when the contract is signed; - your legal guardian, - persons that are a permanent resident in your domicile, - the person in charge during your trip: . the guardian of underage children, provided that his/her name is mentioned when the contract is signed; . the guardian of any disabled persons, provided that he/she lives under your roof, that you are his/her legal guardian and that his/her name is mentioned when the contract is signed; We will only intervene if the sickness or accident officially prevents you from leaving your domicile, requires medical attention, and prohibits you from working or engaging in other activities.
COMPLICATIONS DUE TO PREGNANCY - that lead to the complete termination of any professional or other activities and provided that at the time of departure, the person is not over 6 months pregnant. Or -If the nature of the trip is incompatible with your state of pregnancy provided that you were unaware of your condition at the time of the reservation.
CONTRA-INDICATION AND REPERCUSSIONS OF VACCINATION ECONOMIC LAYOFF -of yourself, -of your spouse, provided that you were unaware of this decision at the time of booking your reservation or signing of the current contract.
JURY SUMMONS, ONLY IN THE FOLLOWING CASES: - jury or witness for Assize courts; -designation as an expert, provided that you were summoned on a date that coincides with the travel period. SUMMONS FOR CHILD ADOPTION Provided that you are summoned on date that coincides with the travel period. SUMMMONS FOR A REMEDIAL EXAM (EXAMEN DE RATTRAPAGE) Following a failure to pass that was unknown at the time of signing the contract (upper level education only), provided that said exam takes place during the trip. DESTRUCTION OF PROFESSIONAL OR PRIVATE PROPERTY due to fire, explosion, or water damage, provided that said properties suffered over 50% damage. THEFT THAT OCCURS IN PROFESSIONAL OR PRIVATE PROPERTY Under the condition that the value of the theft requires your presence and that the theft occurred within 48 hours before your departure.
SEVERE DAMAGES TO YOUR VEHICLE Within 48 hours before your departure and in the event that said vehicle is cannot be used to transport you to the vacation site or meeting point set by the organiser.
PUBLIC TRANSPORTATION ACCIDENT OR INCIDENT used to transport you to a major airport, resulting in a delay over 2 hours, causing you to miss the flight you reserved. This guarantee only applies on the condition that you made the necessary arrangements to arrive at the airport at least two hours before the last boarding call. GRANT FOR A JOB OR INTERNSHIP BY THE A.N.P.E. (Agence Nationale Pour l'Emploi) provided that the person was registered with the A.N.P.E. and that the job or internship starts before or during the trip. Changes to the type of work contract are not insured (eg. Changing a CDD into a CDI) LOSS OR CHANGE OF PAID VACATION DATES BY THE EMPLOYER given before reserving the trip. Does not include CEOs, liberal professionals, artisans and freelance performers. You are still responsible for an exemption of 25% PROFESSIONAL CHANGES imposed by your administration and not as a result of a request on your part. Does not include CEOs, liberal professionals, artisans and freelance performers. You are still responsible for an exemption of 25%. VISA REFUSAL BY COUNTRY AUTHORITIES Provided that you have never been denied a visa request previously by the authorities of the same country. A justification from the embassy is required. THEFT OF ID CARD, PASSPORT, OR INABILITY TO REPLACE VISAS within 48 before departure, provided that these documents are necessary for the voyage and pending on producing a certified declaration of theft delivered by the Police department with jurisdiction over where the theft was reported. WARNING: To be accepted, the declaration of theft must be reported on the day of departure at the latest. You are still responsible for an exemption of 25%.
CANCELLATION OF A PERSON IN YOUR PARTY (maximum 4 persons) Registered at the same time as you and insured by the same contract, if the cancellation is due to one of the reasons listed above. If the person wishes to go on the trip by him or herself, he/she is responsible for any supplemental fees.
WHAT WE EXCLUDE Other than the exclusions listed in the section " WHAT ARE THE GENERAL EXCLUSIONS APPLICABLE TO OUR WARRANTY?," we cannot intervene if the cancellation is a result of: - sickness requiring psychiatric or psychotherapeutic treatments, including nervous depression that does not require a hospitalisation for a minimum of 3 days at the time of cancellation; - Neglect of vaccination; - in the event of a no-show, for any reason (except in the case of theft within 48 hours before departure of ID cards or passports); - sickness or accidents resulting from a first occurrence, relapse, aggravation, or hospitalisation between the date of purchase and the date of signing the insurance contract. Furthermore, we will never intervene if the person that requests cancellation is hospitalised at the time the travel is booked or the time of signing the insurance contract.
FOR WHAT AMOUNT WILL WE INTERVENE? We will intervene for the cost of the cancellation fees incurred the day of the incident that put the warranty into effect, in conformity with the General Sales Conditions of the trip organiser, with the maximum and exemptions indicated in the table of warranty indemnities.
WHEN MUST YOU DECLARE THE DAMAGE? 1/ As soon as you notice the first sign of sickness or as soon as you are aware of the incident that puts the warranty into effect, you must immediately alert O'HARA VACANCES. If you subsequently cancel the trip with the travel agency or the organiser, we will reimburse you the cancellation fees from the first sign of sickness or accident that gives rise to cancellation, in conformity with the conditions of cancellation listed in the General Sales Conditions of the organiser.
2/ However, if the damage was not declared to us by the travel agency or the organiser, you must alert us within five business days following the incident that puts the warranty into effect. To do so, you must sent the declaration of damage attached to the insurance contract that was given to you. WHAT ARE YOUR OBLIGATIONS IN CASE OF DAMAGE? Your déclaration must be accompanied by: - in case of sickness or an accident, a medical certificate detailing the origin, nature, severity, and possible consequences of the sickness or accident, - in case of death, a certificate and a civil registry form, - in other cases, all documentary evidence. You must send us the documents and medical information necessary for the processing of your file in an envelope pre-printed with the name of the doctor, which we will send back to you as soon as we receive the declaration of damage, as well as a medical questionnaire to be filled out by your doctor. If you did not keep the documents or medical information, you must have them sent by your doctor, with a pre-printed enveloped as stated above. You must also send all information or documents that will be requested so as to justify your reason for cancellation, in particular: - all photocopies of medication prescriptions, analyses or tests as well as all documents justifying their delivery or execution, specifically the feuilles de maladies that include a copy of the medicine label that come with prescription drugs. - the deductions from Social Security or any other similar organisation relative to the reimbursement of treatment fees and payment of day-to-day indemnities, - the original bill minus the balance that you are to pay to the trip organiser or which the latter currently holds, - the registration form given by the travel agency or the organiser, - in event of an accident, you must detail the causes and circumstances and provide us with the name and address of those responsible as well as witnesses, if necessary. Furthermore, it is expressly stated that you must accept in advance an examination by our medical advisor. Therefore, if you are opposed to it without a legitimate reason, you lose your guarantee rights.
VACATION INTERRUPTION FEES WHAT DO WE GUARANTEE? Following your medical repatriation, organised by GAN Eurocourtage or by another partner company, you and your insured family members or the persons covered in your current contract will be reimbursed pro rata temporis the cost of the vacation package paid for but unused (not including transportation), including the overnight stays following the incident that provoked the medical repatriation.
Also, if a member of your family who did not participate in the trip becomes seriously ill, suffers a severe bodily harm, or dies, and because of this you are obligated to interrupt your vacation and return home, you and your insured family members or the persons covered in your current contract will be reimbursed pro rata temporis the cost of the vacation package paid for but unused (not including transportation), including the overnight stays following the incident that provoked your early return. We will also intervene in case of theft, serious fire damage, explosion, or damage caused by water or the forces of nature at your professional or private property that require your presence to take necessary conservation measures. You and your insured family members or the persons covered in your current contract will be reimbursed pro rata temporis the cost of the vacation package paid for but unused (not including transportation), including the overnight stays following the incident that provoked your early return. WHAT WE EXCLUDE Other than the exclusions listed in the General Conditions, we do not insure interruptions due to: • Aesthetic treatment, a cure, a voluntary miscarriage, in vitro fertilization and its consequences; • Psychological or mental sickness or depression without hospitalisation of less than three days; •Epidemics. WHAT ARE YOUR OBLIGATIONS IN CASE OF DAMAGE? You must: • IMMEDIATELY contact the help administration PRESENCE ASSISTANCE TOURISME to obtain a file number before any decision to return to your home • Send all documents necessary for your file to PRESENCE ASSISTANCE with evidence that your claim is well founded and the cost of your claim. In all cases, the original bills detailing listing the ground services and transportation services will be requested systematically. Without sending our medical consultant the necessary medical inforomation, the file cannot be processed.
